Abstract:
The newly revised Fisheries Law of the People’s Republic of China, effective as of May 1,2026, establishes a data-centric intelligent regulatory framework, thereby making the protection of fisheries personal information a frontier issue in administrative law.Under this new regime, fisheries personal information has four features:real-time dynamism, high interconnectivity, embedded public interest, and processing diversity. The traditional“notice-and-consent”model faces practical challenges in fisheries enforcement, and current administrative regulations suffer from purpose expansion, procedural gaps, and weak accountability. This paper proposes a tripartite framework —“categorization and tiering,scenario-based regulation, and process-oriented control”— to improve fisheries data management and establish full-process compliance mechanisms, thereby balancing public governance and the protection of personal information rights.
