| 海域立体开发能够使海域开发利用利益最大化，减少对海洋资源的损耗。目前我国对于海域立体开发缺乏相关法律依据。文章梳理国内外关于海域立体开发的研究重点，指出我国可借鉴的研究成果；提出我国现阶段海域立体开发存在的法律问题，包括缺乏法律法规依据、相关规定较宽泛、缺乏海域分层开发利用时序统筹以及缺乏海洋基础数据调查等，并提出加速制定相关法律法规、具体化相关规定、明确海域立体开发时序和明确海洋资源环境承载能力的建议，以期为相关部门提供理论参考。 |

| A Review of the Research on Legal Issues Related to Three-dimensional Development of China′s Maritime Areas |

| The three-dimensional development of sea areas can maximize the benefits of sea area development and utilization, and reduce the loss of marine resources. At present, China lacks relevant legal basis for the three-dimensional development of sea areas. The paper summarized the research focuses on three-dimensional development of sea areas both domestically and internationally, and pointed out the research achievements that China could learn from. Propose the legal issues that exist in the current stage of three-dimensional development of sea areas in China, including a lack of legal and regulatory basis, relatively broad relevant regulations, a lack of comprehensive planning for layered development and utilization of sea areas, and a lack of marine basic data investigation. Propose suggestions to accelerate the formulation of relevant laws and regulations, concretize relevant regulations, clarify the timing of three-dimensional development of sea areas, and clarify the carrying capacity of marine resources and environment, in order to provide theoretical reference for relevant departments. |
