| 摘要: |
| 新修订并施行的《农业行政处罚程序规定》融合了《中华人民共和国行政处罚法》《中华人民共和国行政强制法》等法律规定，在立法、程序及监督3个方面有较大变化，这3个方面的变化转变了农业行政执法的理念，改善了执法部门之间的工作格局。文章通过分析修订并实施《农业行政处罚程序规定》的重要性，结合《农业行政处罚程序规定》的主要变化，讨论《农业行政处罚程序规定》修订对渔政执法的积极影响，最后结合最新修订的《中华人民共和国民事诉讼法》和渔政执法现状，提出《农业行政处罚程序规定》的实施建议。 |

| The Main Changes of Provisions on the Procedure for Agricultural Administrative Penalties and Its Impact on the Enforcement of Fishery Law |

| The newly revised and implemented Provisions on the Procedure for Agricultural Administrative Penalties incorporates legal provisions such as Law of the People's Republic of China on Administrative Penalty and Administrative Compulsion Law of the People's Republic of China, there are great changes in legislation, procedure and supervision, which have changed the idea of agricultural administrative law enforcement, and improved the work between law enforcement departments and pattern. By analyzing the importance of revising and implementing Provisions on the Procedure for Agricultural Administrative Penalties, and combining with the main changes of this law, to discuss the positive impact of the revision of Provisions on the Procedure for Agricultural Administrative Penalties on the enforcement of fishery law, and finally, in the light of the latest revision of the Civil Procedure of the People's Republic of China and the current status of the enforcement of fishery law, the paper put forward the implementation proposal of Provisions on the Procedure for Agricultural Administrative Penalties. |
