| 近年来，随着我国海洋开发利用规模的持续增长，不同项目重叠用海的问题开始凸显，海域立体分层使用模式得到广泛关注。海域立体分层使用以海域的立体性、多宜性等自然属性为基础，以协调竖向空间的用海活动为目的，是未来海洋空间管理制度体系变革的方向之一。现行的海域空间“平面化”管理思路，使海域立体分层使用面临竖向空间边界不清、二维海籍管理模式不适用、缺少立体空间规划及利益相关者协调难度大等问题。通过借鉴土地立体分层使用的经验，结合海域空间自然特征与开发利用特点，分别从海域分层方法、三维海籍信息表达方式、海域立体空间规划、设立海域役权等方面提出对策建议，以期为海域空间立体分层使用提供借鉴。 |

| The Realistic Predicament and System Perfection of the Stereo Stratification Usage of Sea Area |

| In recent years,with the expansion of the ocean development and utilization in China,there comes a serve problem that various marine usage activities conflict with each other when they occupy the same part of the sea area,which draws increasing attention of the pattern of the stereo stratification usage of sea area.As one of the future evolutionary directions of marine management,such a stereo stratification usage system is based on the tridimensional and flexible character of the sea area and aimed to coordinate the vertical marine activities.The existed method is to manage the sea area in a complanate version causing a series of problems,including the dilution of the boundaries,the inapplicable two-dimensional management pattern,the lack of a stereo program,and difficulties of harmonizing the benefits conflicts of the involving parties.By referring to the practical experience of the stereo stratification usage of the land,in order to enlighten the stereo stratification usage and management of sea area,the author offered the proposals in a few aspects,namely,the specific methods of sea stratification,the three-dimensional expression of marine registered information,the stereo program of sea area and establishing servitude of sea area. |
